Standard Social Conference Contest Rules

THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE STACKTx SOCIAL CONFERENCE CONTEST ( THE “SOCIAL CONFERENCE CONTEST”). THE SOCIAL CONFERENCE CONTEST IS INTENDED TO BE CONDUCTED IN THE COUNTRY OF CANADA ONLY, EXCLUDING QUEBEC, AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE SOCIAL CONFERENCE CONTEST CONSTITUTES ACCEPTANCE OF THESE RULES (THE “SOCIAL CONFERENCE CONTEST RULES”).
- The STACKTx Social Conference Contest is sponsored by STACKT Inc. (“STACKT”), located at 28 Bathurst Street, Toronto, Ontario, M5V 0R4.
- Social Conference Contest. There are four (4) free trips for one (1) to attend the 2024 STACKTx Social Conference available to be won (each a “Contest Prize”):
- Each trip will depart from and return to an Eligible City (as defined below)
- Trips departing from Ottawa, Vancouver, and Calgary will include:
- Roundtrip airfare for one (1), departing on the morning of Wednesday, November 20th, 2024 and returning to the city of departure on the afternoon of Thursday, November 21st, 2024
- One (1) hotel room for one (1) night, checking in Wednesday, November 20th, 2024 and checking out Thursday, November 21st, 2024
- Transportation to and from the Winner’s home and Eligible City airport (up to a maximum of $100 each direction)
- Transportation to and from the Toronto airport and Toronto hotel
- The trip departing from Toronto will include:
- One (1) hotel room for one (1) night, checking in Wednesday, November 20th, 2024 and checking out Thursday, November 21st, 2024
- Transportation to and from the Winner’s home and Toronto hotel (up to a maximum of $100 each direction)
- All trips will include:
- One (1) paid lunch for one (1) traveller with the STACKTx team on Wednesday, November 20th, 2024
- One (1) paid breakfast for one (1) traveller with the STACKTx team on Thursday, November 21st, 2024
- One (1) ticket to the STACKTx Social Conference in Toronto, Ontario Canada on November 20th at the Blue Moon Brewery (at 28 Bathurst Street, Toronto, Ontario, M5V 0R4)
The total estimated value of the Contest Prize departing from Toronto is $1,069.89 CAD. The total estimated value of the Contest Prizes departing from Ottawa, Calgary, and Vancouver is $2,119.89 CAD. STACKT shall arrange for all Winner airfare, transportation, and accommodations and will have sole and absolute discretion in choosing airlines and hotels. All Winners must advise STACKT in writing of any accessibility or accommodation requests upon accepting the Contest Prize.
All Winners assume any and all liability caused, or claimed to be caused, by entering, participating in the Social Conference Contest, or the acceptance of the Contest Prize. Contest Prizes must be accepted as awarded and have no cash value. Any unused portion of a Contest Prize will be forfeited and have no cash value. STACKT reserves the right to substitute an alternative Contest Prize of equal or greater value if the Contest Prize, or any portion of it, is unavailable at the time of award.
- ELIGIBILITY:
- To be eligible to enter the Social Conference Contest, each entrant must:
- be a legal resident of Canada, excluding Quebec, and the age of majority in their province or territory of residence at the time of entry; and
- be a member of STACKTx.
- To join and become a member, log on to www.stacktx.com and complete the online registration form in full. By registering as a member and using the STACKTx website, you agree to comply with the following terms and conditions: https://stacktx.com/terms/. Entries will be accepted from all members of STACKTx who meet the eligibility criteria set out in this section.
- The following persons are not eligible to participate in the Social Conference Contest: (i) employees of STACKT Inc. operating as STACKT Market ( “STACKT Market”) and STACKT, their respective parents, affiliates, subsidiaries, related companies, successors and assigns (collectively, the “STACKT Entities”), related advertising and promotional agencies (collectively with the STACKT Entities, the “STACKT Group”); (ii) a member of the STACKT Group; or (iii) current residents of STACKT Market.
- STACKT shall have the right at any time to require proof of identity and/or eligibility to participate in the Social Conference Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to STACKT for the purpose of the Social Conference Contest must be truthful, complete, accurate and in no way misleading. STACKT reserves the right, in its sole discretion, to disqualify any entrant should such entrant fail to supply, or at any stage supply untruthful, incomplete, inaccurate or misleading information in relation to the Social Conference Contest.
- To be eligible to enter the Social Conference Contest, each entrant must:
- CONTEST PERIOD. Starting at 5:00 p.m., Eastern Time, October 11th, 2024 to 9:00 a.m., Eastern Time, November 8th, 2024 (“Contest Period”), after which time the Contest Period will be closed and no other entries shall be accepted.
- HOW TO ENTER.
There is no purchase necessary to enter the Social Conference Contest. To enter, log on to www.stacktx.com/subscribe/ and complete the online registration form in full or if already a member, log on to the STACKTx website using your membership credentials, complete, and submit the Contest entry form. Contest entries are considered received when the Registration form or Contest entry form is recorded on STACKT’s servers, and must be received prior to the end of the applicable Contest Period to be eligible for consideration. Screenshots of submitted entry forms are not proof of entry or receipt of entry.
In addition to the eligibility requirements, there is a limit of one (1) entry per entrant per Contest Period. In the case of multiple entries, only the first eligible entry will be considered and the remainder will be void. Entrants must indicate on their entry form which Eligible City they will be departing from if chosen as a Winner. STACKT will not be responsible for any inaccuracies made by entrants in choosing their Eligible City or any inability to accept or participate in the Contest Prize as a result of such inaccuracies.
Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced without authorization. No communication or correspondence will be exchanged with entrants except with those selected as Winners.
Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with their member account. For the purposes of these Social Conference Contest Rules, the “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain or account associated with the submitted e-mail address account. Each Winner may be required to provide STACKT with proof that they are the authorized account holder of the e-mail address with the winning entry.
- AWARD CONDITIONS.
All incidental costs and expenses not specifically referred to herein as part of the Content Prize (the “Expenses”) are the sole responsibility of the Winner. All Contest elements are subject to availability and substitution. The Winner shall not seek reimbursement for the Expenses from STACKT.
- WINNER SELECTION.
Following the end of the Contest Period, STACKT will randomly select one (1) entry (a “Winner”) from each of Toronto, Ottawa, Calgary and Vancouver (each an “Eligible City”) from all eligible entries received during the Contest Period.
Winners will be notified within 3 business days from the end date of the Contest Period at the email provided in their entry. Each entrant shall be eligible to win only one (1) Contest Prize. The odds of being selected as a potential winner are dependent upon the number of eligible entries received per Eligible City.
All Winners will be presented with, and must correctly answer, a mathematical skill-testing question without assistance of any kind, whether electronic, mechanical or other means, before accepting the Contest Prize.
Each Winner will be required to sign a legal agreement (“Contract”) that confirms their: (i) eligibility for the Contest and compliance with the Social Conference Contest Rules and (ii) acceptance of the Contest as offered from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Social Conference Contest, participation in any Contest-related activity, including but not limited attending the STACKTx Social Conference, or the acceptance, use, or misuse of any Contest Prizes or component thereof, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) grant to STACKT of the unrestricted right to reproduce, convert, publish, broadcast, communicate by telecommunication, exhibit, distribute, translate, adapt, and otherwise use or re-use the entrant’s name, image, likeness, comments, voice and/or biography in any and all media now known or hereafter devised in connection with publicity related to the Social Conference Contest. The executed Contract(s) must be returned within one (1) business day of the date indicated on the accompanying letter of notification or verification as a Winner, or the selected individual(s) will be disqualified and any rights they may have to the Contest Prize will be forfeited. STACKT is not responsible for any failure whatsoever of Winners to receive notice they have won, or any failure to return the executed Contract(s) within the timeframe provided.
- LIMITATION OF LIABILITY. The STACKT Entities assume no responsibility or liability for (i) lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry; (ii) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Social Conference Contest or by any technical or human error which may occur in the administration thereof ; (iii) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (iv) any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing or otherwise; or (v) any injury or damage to any entrant or to any computer related to or resulting from participating or downloading materials related to the Content. STACKT assumes no responsibility or liability in the event that the Social Conference Contest cannot be conducted as planned for any reason, including those reasons beyond the control of STACKT, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of the Social Conference Contest, the Contest, or the STACKTx website.
By participating in the Social Conference Contest, each entrant agrees to be bound by the Social Conference Contest Rules. Entrants further agree to be bound by the decisions of STACKT, which shall be final and binding in all respects. STACKT reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the Social Conference Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Social Conference Contest, the STACKTx website, social media pages, or any related promotional website; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any of STACKT’s property or service; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
- PRIVACY / USE OF PERSONAL INFORMATION.
By participating in the Social Conference Contest, each entrant: (i) consents to the use of their personal information provided when they submit an Application and any Content (collectively, the “Personal Information”) for the purposes of administering the Social Conference Contest, including but not limited to contacting and announcing the winners and coordinating the provision of the Social Conference Contest; (ii) grants to STACKT the right to use their name, social media handles for publicity and promotional purposes relating to the Social Conference Contest in any and all media without further compensation unless prohibited by law; and (iii) acknowledges that STACKT may disclose their Personal Information to third-party agents and service providers of STACKT in connection with any of the activities listed in (i) and (ii) above.
STACKT will use each entrant’s Personal Information only for identified purposes, and protect each entrant’s Personal Information in a manner that is consistent with the STACKT Privacy Policy at: https://stacktx.com/privacy-policy/
- INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by STACKT and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
- TERMINATION. STACKT reserves the right, in its sole discretion, to terminate the Social Conference Contest, in whole or in part, and/or modify, amend or suspend any Contest Rule in any way, at any time, for any reason without prior notice.
- GOVERNING LAW. These are the official Social Conference Contest Rules. The Social Conference Contest is subject to applicable federal, provincial and municipal laws and regulations. The Social Conference Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over STACKT and/or the Social Conference Contest. The Social Conference Contest is void where prohibited by law and subject to all applicable Canadian federal, provincial, territorial, municipal, and local laws. All issues and questions concerning the construction, validity, interpretation and enforceability of the Social Conference Contest Rules or the rights and obligations as between the entrant and STACKT in connection with the Social Conference Contest shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
- DISCREPANCY. In the event of any discrepancy or inconsistency between the terms and conditions of the Social Conference Contest Rules and disclosures or other statements contained in any Social Conference Contest-related materials, including but not limited to the Contest entry form, television, print or online advertising, the terms and conditions of these Social Conference Contest Rules shall prevail, govern and control.
- SOCIAL MEDIA. The STACKTx Social Conference is in no way sponsored, endorsed or administered by any social media platforms on which the Social Conference Contest may have been promoted and/or publicized, including but not limited to Facebook, Instagram and/or X. Any Personal Information provided in connection with the Social Conference Contest is being provided to STACKT and not to Facebook, Instagram and/or X. Any questions or comments regarding the Social Conference Contest or any entry or Contest Prize must be directed to STACKT and not to any of the social media platforms on which the Social Conference Contest may have been advertised or administered.

THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE STACKTx STOREFRONT GRANT PROGRAM ( THE “STACKTx GRANT PROGRAM”). THE STACKTx GRANT PROGRAM IS INTENDED TO BE CONDUCTED IN THE COUNTRY OF CANADA ONLY, EXCLUDING QUEBEC, AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE STACKTx GRANT PROGRAM CONSTITUTES ACCEPTANCE OF THESE RULES (THE “GRANT APPLICATION RULES”).
- The STACKTx Grant Program is sponsored by STACKT Inc. (“STACKT”), located at 28 Bathurst Street, Toronto, Ontario, M5V 0R4.
- GRANT. A free one (1) month rental of a single unit STACKT storefront, located at 28 Bathurst Street, Toronto, Ontario, M5V 0R4, will be awarded during each Application Period, as defined below:

The total estimated value of the “GRANT” is $22,077 CAD. (the “Grant”).

Each Application entry period (each an “Application Period”) shall start and end on the dates and times announced from time to time on the STACKTx website and on STACKT social media platforms, after which time the Application Period will be closed and no other entries shall be accepted for that particular Application Period.

All materials, including without limitation any written content, photographs, or videos, submitted in connection with the Application (the “Content”), will become a full-use license to STACKT and will not be returned for any reason. Submissions will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced without authorization. No communication or correspondence will be exchanged with applicants except with those selected as a potential Grant Application runner-ups and winners.
If Content has been submitted in connection with the Application, each applicant agrees that STACKT may post the Content, in whole or in part, on any STACKT-owned or controlled websites, viewing galleries, and social media platforms. Each applicant further represents and warrants that: (i) the Content does not contain any material that is libellous, defamatory, profane or obscene; (ii) the Content is original and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the applicant to the full extent necessary to enable STACKT to use the Content as contemplated by these Grant Application Rules; and (iii) the Content does not infringe upon the intellectual property or other statutory or common law rights of any third party.

Applications will be assessed based on the following criteria:
a) Product fit and brand alignment within the STACKT ecosystem
b) Sufficient inventory to fulfill a month-long storefront residency
c) Market fit with other stores and businesses in the STACKT ecosystem; and
d) Ability of applicant to move into the designated storefront during the Grant term
Winners will be notified within 15 business days from the end date of the applicable Application Period at the email and or phone number provided in their Application. Each applicant shall be eligible to win only one (1) Grant. The odds of being selected as a potential winner are dependent upon the number of eligible entries received per Application Period. Any remaining entries will not be carried over, and all applicants must re-submit to be considered for subsequent Application Periods.

- PRIVACY / USE OF PERSONAL INFORMATION.
By participating in the STACKTx Grant Program, each applicant: (i) consents to the use of their personal information provided when they submit an Application and any Content (collectively, the “Personal Information”) for the purposes of administering the STACKTx Grant Program, including but not limited to contacting and announcing the winners and coordinating the provision of the Grant; (ii) grants to STACKT the right to use their name, social media handles, and Content, if any, for publicity and promotional purposes relating to the STACKTx Grant Program in any and all media without further compensation unless prohibited by law; and (iii) acknowledges that STACKT may disclose their Personal Information to third-party agents and service providers of STACKT in connection with any of the activities listed in (i) and (ii) above.
STACKT will use each applicant’s Personal Information only for identified purposes, and protect each applicant’s Personal Information in a manner that is consistent with the STACKT Privacy Policy at: https://stacktx.com/privacy-policy/
- INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by STACKT and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
- TERMINATION. STACKT reserves the right, in its sole discretion, to terminate the STACKTx Grant Program, in whole or in part, and/or modify, amend or suspend any Grant Application Rule in any way, at any time, for any reason without prior notice.
- GOVERNING LAW. These are the official Grant Application Rules. The STACKTx Grant Program is subject to applicable federal, provincial and municipal laws and regulations. The Grant Application Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over STACKT and/or the STACKTx Grant Program. The STACKTx Grant Program is void where prohibited by law and subject to all applicable Canadian federal, provincial, territorial, municipal, and local laws. All issues and questions concerning the construction, validity, interpretation and enforceability of the Grant Application Rules or the rights and obligations as between the applicant and STACKT in connection with the STACKTx Grant Program shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
- DISCREPANCY. In the event of any discrepancy or inconsistency between the terms and conditions of the Grant Application Rules and disclosures or other statements contained in any STACKTx Grant Program-related materials, including but not limited to the Application entry form, television, print or online advertising, the terms and conditions of these Grant Application Rules shall prevail, govern and control.
- SOCIAL MEDIA. The STACKTx Grant Application Program is in no way sponsored, endorsed or administered by any social media platforms on which the STACKTx Grant Program may have been promoted and/or publicized, including but not limited to Facebook, Instagram and/or X. Any Personal Information provided in connection with the STACKTx Grant Program is being provided to STACKT and not to Facebook, Instagram and/or X. Any questions or comments regarding the STACKTx Grant Program or any Application must be directed to STACKT and not to any of the social media platforms on which the STACKTx Grant Program may have been advertised or administered.
